TERMS AND CONDITIONS

These General Conditions of Sale regulate the purchase of products offered on the website www.silkincom.com
(hereinafter “the Site”), owned by Marco Dibenedetto – SILKinCOM, with registered office in Via Giuseppe Verdi 2/B, 22072 Cermenate (CO), Italy, Tax Code and VAT number DBNMRC80E04C933Q, REA number CO – 333010, email: silkincom.business@gmail.com

1. Object

These Conditions govern the distance selling of clothing and fashion accessories, currently scarves, made and distributed by SILKinCOM, to private consumer customers (B2C).

The purchase implies full acceptance of these Conditions of Sale.

2. Product features

The products offered are described on the relevant pages of the Site.
Images and descriptions are for illustrative purposes only and may differ slightly in color, texture, or finish, depending on the device used or the craftsmanship of the garment.

3. Prices and taxes

All prices displayed on the Site are expressed in euros (€) and include VAT, where applicable.
For orders destined for non-EU countries, prices are net of Italian VAT; any duties or customs taxes are the customer's responsibility.
Shipping costs are indicated separately before order confirmation.

SILKinCOM reserves the right to change prices at any time, provided that the customer will be charged the price indicated at the time of the order.

4. Orders and payments

Orders can only be placed online through the Website.
Upon confirmation, the customer declares that he has read and accepted these Conditions of Sale.

Payments are handled through Wix Payments and can be made with major credit or debit cards.
Transactions take place on secure third-party servers: the Owner does not store or directly process payment data.

5. Shipping and deliveries

SILKinCOM ships to Italy and worldwide via Packlink and selected couriers based on the destination.

Average delivery times: 3–7 working days in Italy, 3–15 working days abroad.

Shipments are made to the address indicated by the customer during the order phase.

Any delays due to force majeure, customs checks, or logistical conditions are not attributable to the Owner.

7. Right of withdrawal and returns

Pursuant to Legislative Decree 206/2005 (Consumer Code), the customer has the right to withdraw from the contract within 14 days of receiving the product, without having to provide a reason.

To exercise the right of withdrawal, the customer must send a written communication to
silkincom.business@gmail.com

indicating the order number and the product you wish to return.

Return conditions:

the product must be intact, unused and in its original packaging;

return shipping costs are the responsibility of the customer;

The refund will be made within 14 days of receiving the return, using the same payment method used for the purchase.

The right of withdrawal does not apply to personalized or made-to-measure products.

7. Warranties

All products are covered by a 24-month legal guarantee of conformity for manufacturing defects, pursuant to Articles 128–135 of the Consumer Code.

The customer is required to report any defects within two months of discovering them, sending a description and, if possible, images of the defect to the email address indicated above.

8. Limitation of liability

SILKinCOM will not be liable for any damage resulting from improper use of the purchased products or from events beyond its control (delays, courier failures, force majeure).

9. Applicable law and competent court

These Conditions are governed by Italian law.
The Court of Como will have exclusive jurisdiction over any dispute.

Customers residing in the European Union retain the right to appeal to the courts of their country of residence or to use the European ODR platform for online dispute resolution (https://ec.europa.eu/consumers/odr).

10. Changes

SILKinCOM reserves the right to update or modify these Terms at any time, in compliance with applicable law.
The changes will take effect from the date of publication on the Site.
